Terms and Conditions: Portrait Photography Services

  1. Definitions:
    • “Photographer” refers to Cristiana Sto Photography, providing portrait photography services.
    • “Client” refers to any individual, group, or entity engaging the Photographer’s services.
  2. Booking and Payment:
    • Clients must book sessions in advance and provide a non-refundable deposit to secure the date.
    • Full payment is due after the session and before the final images are delivered unless otherwise agreed upon. The final images cannot be released unless the payment is made in full.
  3. Cancellation and Rescheduling:
    • Clients must provide at least 48 hours’ notice for any cancellations or rescheduling.
    • Failure to provide adequate notice may result in forfeiture of the deposit.
  4. Copyright and Usage:
    • The Photographer retains copyright and ownership of all images.
    • Clients are granted a non-exclusive, non-transferable license to use the images for personal use only.
    • Clients may not sell, modify, or use images for commercial purposes without prior written consent from the Photographer. Commercial use requires consulting with the Photographer for a separate agreement.
    • Clients may request an extension of the license for non-exclusive publishing/print usage, subject to negotiation and agreement with the Photographer.
    • Promotional usage of images by the client is only permissible if agreed upon with the Photographer in advance, either in writing or via the agreement.
  5. Model Release:
    • Clients grant the Photographer permission to use images for promotional purposes, including but not limited to website, social media, and marketing materials.
    • Clients may opt out of this provision by notifying the Photographer in writing before the session.
  6. Client Cooperation:
    • Clients are responsible for providing accurate information regarding preferences, locations, and any special requests.
    • Clients must arrive on time for the session and cooperate with the Photographer’s directions.
  7. Delivery of Images:
    • The Photographer will deliver edited images within the time frame specified in the agreement via digital download or other agreed-upon method.
    • Additional editing requests may incur extra charges.
  8. Liability:
    • The Photographer is not liable for any injuries, damages, or losses incurred during the session.
    • Clients are responsible for their own safety and the safety of any props or equipment provided by the Photographer.
  9. Governing Law:
    • These terms and conditions shall be governed by and construed in accordance with the laws of the Netherlands.
    • Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
  10. Acceptance of Terms:
    • By booking a session with the Photographer, clients agree to abide by these terms and conditions.
